MASSENA, NY - State Police arrested Rachel D. Foster, 44, of Brasher Falls following an early morning accident on County Route 53.

Police say that Foster claimed to have swerved to avoid a deer and ran off the roadway. Police indicate that she was significantly intoxicated at the time, having tested her BAC at .21%.

She was charged with 1st-Degree Aggravated Unlicensed Operation, Failure to Keep Right, Felony DWI, and Felony Aggravated DWI.

Foster was arraigned in the Town of Brasher Court and remanded to the St. Lawrence County Correctional Facility in lieu of $7,500 cash bail or $15,000 secured bond.  She is scheduled to return to court on March 5th, 2010 for a preliminary hearing.
